Terms of Service

1. Agreement

By using Kosmo Research services or our WhatsApp AI Interviewer tool, you agree to these terms. If you do not agree, please do not use our services.

These terms constitute a legal agreement between you and Kosmo Research.

2. Definitions

• "Service": Kosmo Research consulting services and WhatsApp AI Interviewer platform
• "Researcher": A user who creates interview campaigns
• "Participant": A person who responds to an interview via WhatsApp
• "Content": Any data, questions, responses, transcripts, or materials uploaded or generated

3. Our Services

Consulting Services:

• Customer discovery and validation research
• User interviews and surveys
• Competitive analysis and market research
• User personas and journey mapping
• UX audits and usability testing
• Deliverables as agreed per project

WhatsApp AI Interviewer:

• AI-powered interview tool via WhatsApp
• Voice message transcription
• Automated summaries and analysis
• Campaign management and data export

4. Consulting Terms

• Projects begin after payment confirmation
• Scope and deliverables defined before project starts
• Delivery timelines are estimates, not guarantees
• Revisions included as specified per package
• Refund available if we fail to deliver agreed scope
• Client owns all research deliverables upon payment

5. AI Interviewer Terms

You (the Researcher) agree to:

• Provide accurate account information
• Obtain proper consent from participants
• Inform participants they are interacting with AI
• Use the tool only for lawful research purposes
• Not exceed your plan's usage limits
• Keep your account credentials secure

You own:

• Your research data and campaign content
• Transcripts and summaries generated from your campaigns
• The right to export and delete your data at any time

We own:

• The Kosmo Research platform, software, and brand
• Aggregated, anonymized insights (not linked to you or participants)

6. Participant Consent

When using the AI Interviewer, you are responsible for:

• Informing participants about the research purpose
• Collecting appropriate consent for your specific research
• Ensuring your research complies with applicable laws
• Responding to participant data requests

Our platform collects basic consent before interviews begin, but additional consent may be required depending on your research.

7. Payments

Consulting:

• Payment via Fiverr or direct invoice
• 50% deposit may be required for large projects
• Final payment due upon delivery

AI Interviewer:

• Payment via Stripe
• Subscription fees billed monthly or annually
• Interview credits do not roll over between periods
• No refunds for used interview credits
• Prices displayed exclude applicable taxes

8. Acceptable Use

You agree NOT to:

• Use our services for any illegal purpose
• Deceive, harass, or harm research participants
• Collect sensitive data (health, political, sexual) without proper consent
• Share your account credentials with others
• Attempt to reverse engineer our software
• Use the service to build a competing product
• Send spam or unsolicited messages
• Violate any applicable laws or regulations

We may suspend or terminate accounts that violate these terms.

9. Indemnification

You agree to indemnify and hold harmless Kosmo Research, its owner, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of our services
• Your violation of these terms
• Your research activities and participant interactions
• Any content you create, upload, or distribute
• Any third-party claims related to your research

10. AI Disclaimer

Our AI tools generate content based on your inputs and participant responses. We do not guarantee:

• Accuracy or completeness of AI-generated content
• Suitability of insights for any specific purpose
• That AI responses will be error-free

You are responsible for reviewing and validating all AI-generated outputs before making business decisions.

11. Intellectual Property

• You own: Your research data, campaign content, and deliverables
• We own: Kosmo Research brand, software, platform, and documentation
• We may use: Anonymized, aggregated data to improve our services (never linked to you or participants)

12. Limitation of Liability

Our services are provided "as is" without warranties of any kind.

We are NOT liable for:

• Business decisions based on research findings
• Participant no-shows or incomplete responses
• Third-party service outages (WhatsApp, OpenAI, etc.)
• Data loss due to factors beyond our control
• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or business opportunities

Maximum liability: Our total liability is limited to the fees you paid us in the 12 months preceding the claim.

13. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may:

• Perform maintenance with or without notice
• Modify or discontinue features
• Experience outages due to third-party providers

14. Termination

You may:

• Cancel your account at any time
• Request data export before cancellation
• Stop using our services

We may:

• Suspend accounts that violate these terms
• Terminate accounts with 30 days notice
• Immediately terminate for serious violations

After termination, your data will be available for export for 30 days, then permanently deleted.

15. Governing Law & Disputes

These terms are governed by the laws of Greece and the European Union.

For disputes:

• We will attempt to resolve disputes amicably
• Unresolved disputes subject to the courts of Thessaloniki, Greece

16. Changes to Terms

We may update these terms. Changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance. Material changes will be notified via email.

17. Severability

If any provision of these terms is found invalid, the remaining provisions remain in full effect.

18. Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and Kosmo Research.
